San Jose Man Accused of Resisting Arrest, Biting Police Dog

A man believed to be under the influence of a controlled substance stabbed himself in the chest three times and bit a police dog while resisting arrest. George Kiriyama reports. And it really happened. But the headline in this case should technically be "Man Bites Police Dog." Santa Clara County Sheriff's spokesman Kurtis Stenderup said they took Frank Garcia, 34, into custody on charges of resisting arrest, brandishing weapon, felony vandalism, being under the influence of a controlled substance and injuring a police dog - all from a bizarre incident on Monday near San Jose. "Ski," the German Shepherd, suffered some scraped paws but is expected to be OK and return to work soon. Garcia's photo was not immediately available because he is recovering from self-inflicted injuries in the hospital. Some of the scuffle was caught on a cell phone video, which shows a deputy - gun raised - trying to talk down a man in a confrontation on Raymond Avenue in unincorporated San Jose.

KCK police dog finds, bites robbery suspect

Fido's lenience was not extended to the U.S. Postal Service, which reported 5,879 bites and attacks last year, 274 more than in 2011. As states continue to crack down on biting dogs and to enact leash laws, the 43 million dog-owning households are increasingly on guard against losing their best friends to animal control and paying through the nose for victims' medical costs and lawsuits, says Loretta Worters, Vice President of the Insurance Information Institute. "There's two lies we hear at the Postal Service. One is, "The check's in the mail," and two is, "My dog won't bite,' " says Mark Saunders, USPS spokesman.

California was tops in the first two categories, then came Illinois, 309 claims, $10 million; Texas, 219 claims, $5.1 million; and Ohio, 215, $5.4 million. At the bottom of the claims per state list were Maine, New Mexico, Montana, Hawaii and South Dakota, Martinez said. The average cost per claim nationally in 2011 was $28,799, Martinez said. Dog Bites Insurance Companies: Man's Best Friend Behind One-Third of All Homeowner Claims

Because of the disproportionate damage they cause to other animals and humans, especially children, some 600 communities across North America have chosen breed selective legislation to ban pit-bull-type dogs. But Calgary opted for responsible pet ownership: strict licencing, public education and owner accountability. So the (unlicenced) pit bulls owner is paying the vet bill. Which is no solace to Arlo and his owners, or other neighbours, now understandably fearful in their instantly-devalued homes. Arlos assailants should be euthanized.

Noted Dog Bite Lawyer Jeff Nadrich Comments on Recent Wisconsin Dog Bite Case

According to Nadrich, Most states have some form of strict liability law, and Wisconsin is no exception. In fact, Wisconsin Statute 174.02 stipulates that 'the owner of a dog is liable for the full amount of damages caused by the dog injuring or causing injury to a person, domestic animal or property.' Nadrich further notes that this particular case is still under investigation, and not all of the details have yet come to life. Of course, everyone is innocent until proven guilty, and right now, all we really know is that a woman was injured by two dogs. The police will determine the extent of liability, based on the evidence at hand. According to the ABC report, the 32-year-old victim has undergone surgery for her serious bite wounds. She is expected to make a full recovery, but police say that her prognosis may have been been much worse if not for the "heroic efforts" of her neighbors, who pulled her to safety when the two dogs attacked. "I can't say enough about what those neighbors did. They went toward the danger; they didn't run from it. They went toward to the screams, and they grabbed that woman and pulled her to safety.

Sometimes, it's a man-bites-dog world

The deputy called for emergency aid, and several officers with the sheriff's department and San Jose police arrived at the scene. At that point, the man continued to be confrontational toward the officers, and stabbed himself three times in the chest, causing injuries not considered life threatening. Officers released the police dog, and the subject "basically assaulted the dog by biting, punching and choking it," Stenderup said. He dropped the knife in the scuffle with the dog and officers were able to move in and take him into custody. One officer suffered unspecified injuries in the takedown. Stenderup said the man is believed to have been under the influence of a controlled substance. He credited officers with taking the subject into custody without further injury. "If anything, we are very proud of our deputies for showing the restraint they did," he said.

Barbara Kay: Dog bites man — again and again

Among 98 patients seen with bites over the course of a year, only 63 (64%) were discharged on the appropriate antibiotic, according to Stephanie Fenwick, PharmD, of the Christ Hospital in Cincinnati, and Sarah Rotman, PharmD, of the University of Cincinnati. The latest problem with dogbite is the emergence of MRSA [methicillin-resistant Staphylococcus aureus] bacteria as the most common identifiable cause of skin and soft-tissue infections seen in the emergency department. Treatment of dog bite depends on the type of bacteria the "oral flora" that's in the dog's mouth and the bacteria already on the skin of the bite victim. Amoxicillin-clavulanate is recommended as first-line treatment in most instances, she explained. Treatment may include antibiotics. In the study, only 57% of patients were given amoxicillin-clavulanate monotherapy. The wounds treated in the study included 55 dog bites, 29 human bites, and 13 cat bites.

Your Legal Rights If a Dog Bites You [Video]

Most states make dog owners automatically liable for all dog bites. A few states require the victim to prove the dog was vicious or that the owner violated an animal control law, such as a leash law. If you are the victim of a dog bite, there are several steps you should take: Get medical attention right away.Large dogs can exert more than 450 pounds of pressure per square inch enough to crush bones. Notify animal control and file a police report about the dog that attacked you. Take pictures of the wound to prove the extent of your injury. Check the laws governing dogs. Most cities require a dog to be on a leash, and some states have vicious dog laws. In Ohio and Maryland, for example, pit bulls are considered inherently dangerous and the owners are strictly liable for injuries they cause.

The tender prepared by the officials of the health and the sanitation wing and MC additional commissioner Sumeet Jarangal, was submitted to the commissioner RK Verma on August 16, after which he suggested some changes in the penalty clause of the tender. After this the tender was supposed to be floated by August 20, but in vain. An official of the health wing said that the commissioner had asked officials to re-structure the tender on August 16 and finally submit it by August 20. However, the tender is still waiting to get re-structured, as a result of which the stray-dog menace continues unabated. Amarjit Singh Sekhon, joint commissioner of the MC, said that tender would be submitted soon to the commissioner. In a meeting on August 16, several points were discussed between the officials and Verma, in which the issue of stray-dog menace was raised. The commissioner is serious in tackling the menace and has been making efforts since long to do away with the problem. Earlier, the MC had asked NGOs to extend help in sterilising stray dogs, but the civic body was surprised to know that there was no NGO registered with the Animal Welfare Board of India and capable of doing the task.

The number nearly doubled between the 2008 and 2012 fiscal years, hospital statistics show. While there are some exceptions, canine experts say the trend points to uneducated and inhumane actions by people, not mean dogs. Too often, owners unwisely try to stop dogfights by getting in the middle of them. In the most recent fiscal year, 328 people were admitted to the University of Arizona Medical Center for dog bites, the data show. Those admitted include both adults and children, and they are typically bitten by their own dogs, says Dr. Tolga Turker, a reconstructive and plastic surgeon at UA Medical Center who treats many dog-bite patients.

Despite the large number of attacks on letter carriers, the Postal Service decided to focus on children for their campaign because a child is 900 times more likely to be attacked than a letter carrier, Maher said. Heredity, training, socialization, health, and the behavior of humans around it can all contribute to a dog's tendency to bite, Martinez said.

When dog fighting was banned in the UK in 1835 breeders wanted to keep the breed and focused on enhancing the dog as a companion. The AKC now recognizes three breeds that originated in this effort, the American Staffordshire Terrier, Staffordshire Bull Terrier and Bull Terrier, all of which are the result of over a century of this careful breeding for solid temperament. Since pit bulls were introduced in America they've grown in popularity in some circles for their reputation and fear factor. Often times being used in illegal dog fighting rings. "History has shown that the public tends to generalize a specific breed with aggression. Years ago it used to be the Doberman, it used to be the Rottweiler, the German Shepherd, right now it's the pit bull," said Nicole Montano, SCRAPS' Animal Protection Manager.

But the animal's owner should not have to pay any more than what is legally owed. In today's "get something for nothing" world, it is not uncommon for persons injured on the job or in an accident to try to "milk" the injury into an unjustifiably large settlement or a long period of "disability" payments. An on-site police report can actually be helpful and keep a victim from successfully claiming injuries and complications that could not possibly have been a result of the dog bite. It also proves that the dog owner stayed around to make sure that the victim's medical needs were documented. Maintain Available Vaccination Records It is bad enough having your dog bite a member of the public. It's even worse to end up with your dog getting arrested and hauled off to the doggie lockup because you can't get your hands on proof of vaccination . And heaven forbid your dog should bite somebody, say, on the Friday of a Monday holiday weekend: If you personally possess no rabies vaccination proof and your veterinarian and town clerk are closed for the long holiday, you don't even want to imagine the liability should the victim have to begin antirabies therapy as a result of your negligence.

Los Angeles, CA (PRWEB) August 19, 2013 Australian Local Government Minister Don Page has reportedly proposed new legislation that would place much greater restrictions on dogs who exhibit aggressive behaviors, according to a recent report from The Daily Telegraph. According to the article, Page laid out his plans at a state budget estimates hearing, and if enacted, the new legislation would force so-called menacing dogs to be muzzled, even if they haven't bitten anyone. Noted dog attack lawyer Jeff Nadrich recently commented on the story, and its legal implications. According to Nadrich, We know that dog bites are on the rise, but legislation like this may prove controversial. If I understand it correctly, local officials would be able to use their own discretion in determining aggressive behavior, even if the dog has never bitten anyone. Some might argue that this paves the way for abuse, and enables overzealous advocates to unfairly muzzle dogs with no real dangerous tendencies. The Daily Telegraph article further notes that Page's initiative hopes to reduce the number of dog bites in New South Wales. The article quotes Page as saying, The main reason is that we will be able to identify a dog that has been behaving in an aggressive fashion - that is not necessarily a dangerous dog...but one which has shown aggressive tendencies. His plan would reportedly also subject dog owners to increased penalties, and could even ban breeds that are known for aggressive behavior. If a dog is deemed menacing, it could be subject to muzzling, and required to be supervised at all times by a person over the age of 18, according to the Daily Telegraph report.

So the (unlicenced) pit bulls owner is paying the vet bill. Which is no solace to Arlo and his owners, or other neighbours, now understandably fearful in their instantly-devalued homes. Arlos assailants should be euthanized. Instead they will be assessed, after which they may get a second chance, as juvenile first (human) offenders usually do. Trouble is, dogs are not humans. The purpose-bred fighting breed cluster pit bulls represent, genetically programmed for impulsive aggression, cannot be trained into reliable sociability, any more than greyhounds can be trained to adopt the running gait of a sled dog.

Strawberries. Eat all you want! Los Angeles carriers recorded the most bites with 83; San Diego was second with 68; followed by Houston at 47; and Cleveland at 44. Medical expenses from dog attacks cost the Postal Service just over $1 million last year, officials said. The third full week each May is National Dog Bite Prevention Week and State Farm, the U.S. Postal Service, the American Veterinary Medical Association and CDCP release dog bite statistics and launch campaigns to promote dog safety. Despite the large number of attacks on letter carriers, the Postal Service decided to focus on children for their campaign because a child is 900 times more likely to be attacked than a letter carrier, Maher said.

Here is a common local leash law: Every dog shall be leashed at all times except only when it is inside the residence of its owner, or upon the property of its owner that is enclosed by a fence. A dog will be considered to be leashed only when the leash is six feet or less in length or is a retractable leash, and is being grasped by an adult (provided that if the dog is less than 20 pounds then the leash may be grasped by a person who is competent to handle the dog and is over 12 years of age.) If you are walking your dog without a leash, and your city or county has a leash law, you can be held responsible for anything bad that happens as a result of your dog being off the leash. If it chased a child who was riding a bicycle, and caused the child to have an accident by falling off the bike or crashing into something, you would be held liable for that. What about fenced dogs? A dog shall not be considered enclosed by a fence when and if the dog can pass through, under or over the fence, or the gate of the fence is not securely latched.

According to the American Society of Plastic Surgeons, there were close to 27,800 reconstructive procedures, including ones for children, to repair dog bites in 2012. Most homeowners' policies, says the Institute, provide liability coverage of $100,000 to $300,000. If the claim exceeds the limit, the dog owner is responsible for all damages above that amount, including legal expenses. Most insurance companies insure homeowners with dogs, according to the Institute. But some charge more to people owning breeds that an insurer may regard as bite-prone, such as pit bulls and Rottweilers. Some cover the owner only if the dog is taken to behavior classes or is restrained in public with a muzzle, chain or cage. Others deny coverage altogether.

Cephalosporins: Antibiotics sometimes given to dog-bite victims Cephalosporins are indicated for the prophylaxis and treatment of infections caused by bacteria susceptible to this particular form of antibiotic, according to the Wikipedia site on cephalosporins . First-generation cephalosporins are active predominantly against Gram-positive bacteria, and successive generations have increased activity against Gram-negative bacteria (albeit often with reduced activity against Gram-positive organisms). Common adverse drug reactions (ADRs) (1% of patients) associated with the cephalosporin therapy include: diarrhea, nausea, rash, electrolyte disturbances, and/or pain and inflammation at injection site. Infrequent ADRs (0.11% of patients) include: vomiting, headache, dizziness, oral and vaginal candidiasis , pseudomembranous colitis , superinfection , eosinophilia , and/or fever. What happens when you have a penicillin allergy and a dog bite? Many of the patients in the study that were given inadequate therapy had a penicillin allergy. Of 13 such patients, only two received an appropriate alternative. The issue health care professions are concerned about are the large number of inadequate treatment scenarios.

John Barrette: Man bites dog! Water hazard bites man! Want to comment?

You may be puzzled about this man-bites-dog stuff, but folks who know Richards wont be perplexed upon learning he had no comment Friday when asked about water and his golf course. Richards rarely passes up an opportunity to comment on the citys Eagle Valley Golf Course complex, leased to another operator, though he sometimes asks a reporter afterward not to print all his views. But this time it was little but no comment. Of course, reporters must honor that; when it comes to columnists, even though rules still apply, the speculative realm gets to rear its subjective head. And the reporter/columnist ruminating here has played this water hazard-infested golf course hole before. It featured a different twist earlier this year, but as pre-Socratic Greek philosopher Heraclitus said long ago, You can never step in the same water hazard twice. Actually, he said river, but a loose translation will suffice. If youve plunked in one water hazard, it feels like youve dunked in them all.

Dog Bite Prevention Week: A Time to Take Responsibility for Dog Bites

His plan would reportedly also subject dog owners to increased penalties, and could even ban breeds that are known for aggressive behavior.

dog bites When you think about it this makes sense. You can joke around with and even run up to and hug friends on the street, but with strangers and even with co-workers or acquaintances, those same behaviors can been seen as a threat, insult, or just plain rude. If you randomly tried to perform these behaviors with people around you, many would put up with it, but eventually someone might attack you. These rules of comfort and safety extend to dogs that you do know fairly well dog bite lawyer too. It's important to realize that just being around a dog a lot does not mean the dog likes you or feels comfortable with you in all contexts. And just because a dog is friendly to you when you are being polite does not mean he will be comfortable when you are being rude or interacting inappropriately. Hernandez describes one case of a family who took their Cocker Spaniel as well as their child and her friend on vacation in a camping ground. It was the first thing in the morning and their dog was tied out with them.

As a U.S. Postal Service slogan in support of National Dog Bite Prevention Week says, "There are 70 million good dogs, but ANY DOG CAN BITE ." And whom do dogs most often bite? Toddlers. Next, the elderly; and coming in third--you guessed it--postal carriers. "Dog bites are the ninth leading cause of unintentional nonfatal injury to children ages 5-9," Kathy Voigt, president of Prevent The Bite , tells ABC News. "More than 2 million children are bitten by dogs every year, and most bites are from their own dog or a dog they know well. The majority of bites to smaller children are in their face and head." The scenario that keeps Emily Patterson, animal welfare scientist for the American Veterinary Medical Association , awake at night, she says, is a very young child left alone with the family dog. Children are easy to injure, she notes.

Marilyn Keech has been training dogs since 1980 and works as a area trainer for PetsMart's dog trainers. She says dog usually bite out of fear if not socialized when young. "So some of those dogs might be wonderful at home but in the wrong situation without the proper training incidents can happen," said Keech. Because of the strength of their bites and reputation it's possible pit bull bites get reported more often than other dogs. Something Draper says is causing others to miss out on a great companion. "I think it's sad for the dog," said Draper.
