Pleasanton: Couple arrested after dog bites son twice in the face

In a decision dated December 21, 2012, the Superior Court of New Jersey, Appellate Division, found that a paid pet sitter can recover for damages due to injuries suffered from being bitten by a dog that was in her care. Jane Levine Fuccillo and William Fuccillo, Defendants- respondents, Superior Court of New Jersey, Appellate Division, Docket No. A-1273-11t1, the court addressed whether dog owners can be held liable if their dog bit the person whom they've paid to care for it. In order to fully understand the issue, a review of New Jersey law is in order. When it comes to dog bites, New Jersey is a "strict liability" state. In other words, legal liability is strictly imposed by state law (statute) on the owner of a dog that bites someone.

New NJ Rulings on Dog Bite Liability Favors Injured Pet Sitters

Bretzing said Pleasanton police were called to the apartment on Bernal Avenue on May 19 to investigate the dog bite; officers soon discovered the previous biting incident, on March 6, which had gone unreported to police. Kornberg's son suffered multiple facial injuries in the May 19 incident; he was transported to a hospital and later released. On March 6, he had been treated for similar injuries and released. Police said that in both cases, the child had been left alone in a room with the dog. Prosecutors issued felony warrants for Kornberg and Myrvete, and the child was placed with Alameda County Child Protective Services. The dog, whose name is "Boston," was taken to the Alameda County Dog Shelter in Dublin, where it underwent home quarantine and was later released without any issues. On May 28, a public dog hearing was held in Pleasanton and a judge determined the dog to be vicious.

Amala cited the records of the Institute of Preventive Medicine (IPM) to state that there were no deaths due to stray dog bites in the last few years. But there might be instances of deaths in cases where people come to the city for treatment from other places. "Even dog bites reported in the city have come down by nearly 15,000 due to the sincere and coordinated effort of the Greater Hyderabad Municipal Corporation (GHMC)," she said. Garbage Ms. Amala underscored the link between garbage and stray dogs and called upon residents to keep their colonies free of garbage heaps.
