Fortunately, for those afflicted with a dog bite injury in California there is a state statute that makes a dog's owner strictly liable for any damages caused by a dog's bite - regardless of whether the dog in question ever previously bit someone. Dog bite liability in California Under old common law rules, dog owners could only be held liable for dog bites if they had prior knowledge of their dog's propensity for violence. Essentially, this meant that a particular dog would have to bite someone before the owner would be aware that the dog was violent, and thus the owner could not be held liable for his or her dog's first bite. Consequently, this tenet of law became known as the "one-free-bite" or "first-bite" rule. However, in the 1950s California lawmakers passed a law that effectively abolished the "one-free-bite" rule in the context of dog bites.

The teen was at the corner of Scotch Plains Avenue and Dorian Road when he was bitten. According to the boy's mom, the person walking the dog did not stop to provide any contact information. As a result, the family does not know how to get in touch with the owner of the dog to verify it has been vaccinated. The person walking the dog was last seen on Dorian Road walking west toward Lamberts Mill Road. "We are doing everything possible to find this dog," said Mercedes Ponytz, mother of the victim. "We don't want to create any problems for the owner nor the dog. We just want to avoid having our son go through a painful series of shots.
